Default Can I sue if a restaurant window shattered when I leaned on it and cut

me all up and I had to seek medical att? So the other night I was with some friends and I saw some other friends in this diner that a lot of people go to (it is in an older building) And I wanted to get their attention. So this diner has huge windows they are about 4 by 5 foot frames about 3 feet off the ground, so I put my hands on the window and leaned on it to tap on it but when I pressed against the glass the entire window shattered cutting me numerous times, which will end up leaving scars on my hands and arms.

The glass was not tempered, so it broke in big dagger like pieces leaving shards of glass in my skin, some having to remove through out the next day.

I have some friends saying I should sue, I was wondering if it sounds like I have a case ?

PS I live in California if that matters.

Don Juan, although I understand that, I did not use the window in an abusive way, in fact there was a kid in my highschool that during a fight he was thrown through a window that was not tempered, he ended up suing and winning because of it, my accident and his happened in the same county. He obviously was not using the window as intended.

I wanted to clarify something, when I meant put my weight against it, it wasn't any more weight then you would put against a window when you clean it.

I would say that a lawsuit would be ridiculous. You were not using the window in a manner that it was intended for, there for any injuries you suffered would be your own fault.

You definetly have a case, in the united states you are even more likely to win cases like this, but if you really want to ruin and destroy this resturants buisness and the owners finnacial well being because of a few cuts, be my guest

You more than likely have a case.

My mother's cousin slipped on a bit of water in K-Mart and she won that case. My aunt's husband was under a friend's car, working on it, and it rolled over him. He sued his friend's insurance company (for not paying) and won that.

A woman sued McDonald's when she spilled hot coffee on her lap.

People sue for all kinds of things, stupid or not. It sounds like a case, so go for it if you want.
